Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Greek Olive Fusion website at https://www.greekolivefusion.com (the "Site") and any purchases you make through it. The Site is operated by Greek Olive Fusion, LLC ("Greek Olive Fusion," "we," "us," or "our").

By visiting the Site, browsing our products, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, Shipping Policy, and Returns Policy, each of which is incorporated by reference. If you do not agree to these Terms, please do not use the Site.

Eligibility

To use the Site and place an order, you must be at least 18 years old, or the legal age of majority in the state where you live, whichever is older. By using the Site, you represent that you meet this requirement.

Purchases are available only to customers with a valid shipping address located within the fifty United States. We do not currently ship to U.S. territories, military APO/FPO addresses, or destinations outside the United States. Orders placed from outside our shipping area may be cancelled and refunded.

Your Account

You may browse the Site without an account, but creating an account makes checkout and order tracking easier. When you create an account, you agree to:

• Provide accurate, current, and complete information.
• Keep your login credentials confidential and not share your account with others.
• Maintain only one account per person.
• Promptly update your contact and shipping information if it changes.
• Notify us right away if you suspect unauthorized use of your account.

You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that contain inaccurate information or that we believe are being used in violation of these Terms.

Products, Descriptions, and Pricing

We try hard to describe and photograph our products accurately, but minor variations are normal. Product images, descriptions, ingredient lists, weights, and packaging are provided as a good-faith approximation and may differ slightly from the item you receive. Always read the physical product label for the most current ingredient, allergen, and nutrition information before consuming a product.

All prices on the Site are listed in U.S. dollars and do not include shipping or applicable sales tax, which are calculated at checkout. We may change prices, product offerings, and promotions at any time without prior notice. Such changes will not affect orders that have already been accepted by us.

Despite our best efforts, the Site may occasionally contain errors in pricing, descriptions, or availability. We reserve the right to correct any such errors and to cancel or refuse orders placed based on incorrect information, even after an order is submitted. If we cancel an order for this reason after you have been charged, we will issue a full refund.

We may also limit the quantity of any item you can purchase in a single order or over a period of time, and product availability is always subject to change without notice.

Orders and Order Acceptance

When you place an order through the Site, you are making an offer to purchase the items in your cart at the prices and on the terms shown at checkout. Receiving an order confirmation email does not mean we have accepted your order; it confirms only that we received it.

Your order is accepted when we ship the items to you, at which point a contract of sale is formed for the shipped items. We may, in our discretion, refuse or cancel any order before shipment for reasons that include but are not limited to:

• Suspected fraud or unauthorized use of a payment method.
• Pricing, description, or inventory errors.
• An item being sold out or discontinued.
• Inability to verify your shipping or billing information.
• Orders that appear to be for resale or commercial redistribution.

If we cancel all or part of your order before shipment, we will refund any amounts charged for the cancelled items.

Payment

Payments on the Site are processed by Clover through Clover Hosted Checkout. By submitting an order, you authorize us, through Clover, to charge your selected payment method for the full order total, including the product price, shipping, and any applicable sales tax.

You represent that you are authorized to use the payment method you provide and that the billing information you submit is accurate. If your payment is declined or reversed for any reason, we may cancel your order or suspend your account until the matter is resolved.

If you believe there is an error on your statement, please contact us before initiating a chargeback so we can try to resolve the issue directly. Filing a chargeback for a charge you actually authorized, after receiving the product, may result in your account being suspended and may be referred to collections.

Shipping and Risk of Loss

Shipping options, rates, and estimated delivery times are described in our Shipping Policy. We currently ship only to addresses within the fifty United States.

Some products may be shipped directly to you by Ariston Specialty Foods, an independent supplier, on Greek Olive Fusion's behalf. Regardless of who physically ships an item, your contract of sale for the product is with Greek Olive Fusion.

Title and risk of loss for all products pass to you when we deliver the products to the shipping carrier. If a package is lost, stolen, or damaged in transit, please contact us and we will work with you and the carrier on a reasonable resolution, consistent with our Returns Policy.

Returns and Refunds

Returns, refunds, and replacements are governed by our Returns Policy. Because we sell perishable and consumable food products, returns are limited and many items are not eligible for return once they have been opened, used, or left our or the supplier's possession. If you receive an item that is damaged, defective, or materially different from what you ordered, please contact us within the timeframe described in the Returns Policy so we can make it right.

Allergens and Dietary Disclaimers

Our products include olives, olive oils, cheeses, spreads, and other specialty Mediterranean foods. These products may contain, or be produced in facilities that also handle, common allergens including tree nuts, peanuts, sesame, wheat and other sources of gluten, dairy, eggs, soy, fish, and shellfish. Cross-contact can occur even when an allergen is not listed as an ingredient.

You are responsible for reading the physical product label, ingredient list, and allergen statement on each item you receive before consuming it or serving it to others. If you have a food allergy, intolerance, dietary restriction, or medical condition, do not rely solely on the descriptions on the Site.

Statements on the Site about flavor, origin, tradition, or pairing are for general informational and culinary purposes only. They are not medical, nutritional, or dietary advice and are not intended to diagnose, treat, cure, or prevent any condition. Always consult a qualified healthcare professional regarding your individual needs.

Intellectual Property

The Site and all content on it, including the Greek Olive Fusion name and logo, product photographs, copy, graphics, page layouts, recipes, and underlying code, are owned by or licensed to Greek Olive Fusion, LLC and are protected by U.S. and international intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Site for the purpose of browsing and purchasing products for personal, non-commercial use. You may not copy, reproduce, republish, modify, distribute, sell, frame, mirror, scrape, or create derivative works from any part of the Site without our prior written permission. Trademarks, product names, and logos belonging to third parties remain the property of their respective owners.

User Content

You may have the opportunity to submit reviews, ratings, comments, photos, or other content to the Site ("User Content"). By submitting User Content, you grant Greek Olive Fusion a worldwide, royalty-free, perpetual, irrevocable, sublicensable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, and display that content in connection with our business, including marketing and promotional materials.

You represent and warrant that you own or have all necessary rights to the User Content you submit, that it is accurate, and that it does not violate these Terms or any third-party rights. You agree not to submit content that is unlawful, fraudulent, defamatory, obscene, threatening, hateful, infringing, invasive of privacy, or otherwise objectionable. We may, but are not obligated to, monitor, edit, or remove User Content at our discretion.

Prohibited Uses

You agree not to use the Site to:

• Violate any applicable law, regulation, or third-party right.
• Scrape, harvest, or otherwise collect data from the Site by automated means.
• Reverse-engineer, decompile, or attempt to access the source code or underlying systems of the Site.
• Bypass, disable, or interfere with security or access-control features.
• Place automated, bulk, or repetitive orders, or use the Site for resale or commercial redistribution without our prior written consent.
• Introduce viruses, malware, or any other harmful code.
• Impersonate another person or misrepresent your affiliation with any individual or entity.
• Use the Site in any way that could damage, disable, overburden, or impair it.

We may investigate and take legal action against anyone who violates this section, including referring matters to law enforcement.

Third-Party Services and Links

The Site relies on services provided by third parties, including Clover for payment processing, Resend for transactional email delivery, and Ariston Specialty Foods for certain shipping and fulfillment. The Site may also contain links to third-party websites or resources.

These third-party services and sites are not under our control. We do not endorse and are not responsible for their content, products, practices, or policies. Your use of any third-party service is governed by that third party's own terms and privacy policy, and any dispute relating to that third party is between you and them.

Disclaimer of Warranties

THE SITE AND ALL PRODUCTS, CONTENT, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GREEK OLIVE FUSION DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or its servers are free of viruses or other harmful components. Some states do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you. In that case, any implied warranties are limited to the maximum extent permitted by law.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL GREEK OLIVE FUSION OR ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER THAT GAVE RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Greek Olive Fusion and its owners, officers, employees, affiliates, suppliers, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any User Content you submit.

Termination

We may suspend or terminate your access to the Site or your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or unlawful activity, or otherwise created risk for us or other customers. You may stop using the Site or close your account at any time by contacting us. Sections of these Terms that by their nature should survive termination will survive, including the sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

Governing Law, Disputes, and Venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of State of Florida, United States, without regard to its conflict-of-laws principles.

Before filing any legal action, you agree to first contact us at [support@greekolivefusion.com] and attempt to resolve the dispute informally. We will make a good-faith effort to respond and work toward a resolution within thirty (30) days of receiving your written notice.

If the dispute is not resolved informally, you and Greek Olive Fusion agree that the exclusive venue for any legal action will be the state or federal courts located in State of Florida, United States, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from bringing an individual claim in a small-claims court of competent jurisdiction.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

These Terms, together with our Privacy Policy, Shipping Policy, Returns Policy, and any order confirmation you receive from us, constitute the entire agreement between you and Greek Olive Fusion regarding your use of the Site and supersede any prior agreements on the same subject.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, our products, applicable law, or our policies. When we make material changes, we will post the updated Terms on the Site and revise the "Effective Date" at the top of this page. Your continued use of the Site after the updated Terms are posted means you accept the changes. If you do not agree to the updated Terms, please stop using the Site.
